1. Agreement to these terms
These Terms of Use (“Terms”) form a binding agreement between you and nanoSEO (“nanoSEO”, “we”, “us” or “our”) for the nanoSEO website, checkout, audit service, reports, exports, and related features (together, the “Service”). By using the Service, requesting an audit, or completing a purchase, you agree to these Terms and acknowledge our Privacy Policy.
You must be legally able to enter into a contract where you live. If you use the Service for a business, you confirm that you have authority to bind that business. If you do not have that authority, or you do not agree to these Terms, do not use the Service or complete a purchase.
The Service is intended for professional and business use, but nothing in these Terms excludes rights available to consumers under mandatory local law.
2. The Service
nanoSEO performs automated, publicly accessible SEO checks. Depending on the plan and options you select, we may discover pages from a sitemap and internal links, scan pages you choose, collect technical and on-page signals, calculate scores, identify findings, and produce a report with recommendations and exports.
The Service checks publicly reachable HTTP and HTTPS pages. It does not bypass logins, paywalls, password gates, CAPTCHAs, or other access controls, and it does not audit private systems unless they are publicly reachable and you are authorised to submit them. A scan can be affected by robots rules, JavaScript, server responses, rate limits, network conditions, page changes, or third-party blocking.
SEO is not an exact science. We do not guarantee that a scan will discover every page, reproduce the behaviour of every search engine, detect every issue, or produce a particular ranking, traffic, revenue, indexing, or business outcome. Search engines and other third parties control their own systems, policies, and results.
3. Plans and limits
Plans are sold as one-off purchases unless a plan expressly says otherwise. Each plan has the page limit and feature set shown at checkout at the time you order. Plan names, prices, page limits, features, availability, and included outputs may change for future purchases, but a completed order is governed by the details shown when that order was placed.
- Automatic mode lets nanoSEO choose pages using the site’s sitemap, internal links, and other public discovery signals, up to the plan limit.
- Manual mode scans only the same-site page URLs you select, up to the plan limit.
- Page limits are maximums, not minimum entitlements. A site with fewer eligible pages may produce fewer scans.
- Features are tier-dependent. Higher plans may add checks, comparisons, exports, link maps, sitemap-gap analysis, or other capabilities that lower plans do not include.
- We may refuse or limit a scan where it would create a security, legal, operational, or abuse risk.
4. Orders, pricing, and payment
You place an order by choosing a plan, identifying an authorised website, selecting a scan scope, accepting these Terms and the Privacy Policy, and submitting payment through the NanSwap checkout embedded in nanoSEO. An order is not confirmed as paid until the payment provider reports a qualifying confirmation to us or our systems verify it.
Prices are shown in the currency displayed at checkout. Crypto amounts, exchange rates, network fees, miner fees, and payment-provider fees can change before a transaction confirms. You are responsible for the wallet, exchange, network, and third-party fees needed to send a payment. We do not receive or store your private wallet keys or card details.
You are responsible for any taxes, duties, levies, or similar charges that apply to your purchase and are not included in the displayed price. If a payment is late, reversed, underpaid, overpaid, duplicated, or cannot be verified, we may delay, suspend, correct, or cancel the affected order. We may issue a replacement payment request or refund an amount we can identify as owed, subject to applicable law and payment-provider rules.
Discount codes are subject to their stated eligibility, expiry, usage limits, and minimum order value. They have no cash value, cannot be combined unless stated, and may be withdrawn or corrected if used in error or in breach of these Terms.
5. Refunds and cancelled orders
Because an audit is digital content and processing may begin immediately after payment, payments are generally final once the audit has started, except where a refund is required by law or we choose to provide one. If we cannot deliver the purchased audit because of a failure within our reasonable control, contact us with the order ID and we will investigate and, where appropriate, rerun the audit, provide a reasonable substitute, or refund the affected amount.
Nothing in these Terms removes a statutory cancellation, refund, repair, replacement, or other consumer right that cannot lawfully be excluded. If you buy as a consumer and the law gives you a cancellation period, the rules for digital content and services may depend on when performance began and whether you expressly requested immediate supply. Contact cw228911@gmail.com if you believe a statutory right applies.
Refunds are normally returned through the original payment route or another lawful method we reasonably select, less any non-refundable network or third-party charges where the law permits. Crypto price movements and fees charged by your wallet, exchange, or network are outside our control and are not amounts we receive.
6. Your responsibilities
You are responsible for the URLs, information, and instructions you submit. By submitting a URL, you confirm that you own it, administer it, or have permission to have it scanned. You must not submit credentials, private keys, confidential query strings, or personal data that is not necessary for the audit.
You are responsible for reviewing findings before acting on them, testing changes in a suitable environment, keeping backups, and obtaining any professional advice you need. You must keep your report links and exports confidential if they contain information you do not want others to see. You must comply with all laws, third-party terms, search-engine guidelines, and rights that apply to your site and your use of the Service.
7. Acceptable use
You must not use the Service to:
- scan a site without authority, evade access controls, or access private, internal, authentication-only, or unlawfully obtained material;
- break the law, infringe intellectual-property or privacy rights, distribute malware, facilitate fraud, or interfere with another person’s systems;
- overload, probe, scrape at excessive volume, or attempt to disrupt nanoSEO, Cloudflare, NanSwap, a target site, or any other provider;
- reverse engineer, bypass, resell, sublicense, or attempt to extract source code or non-public data from the Service, except where the law expressly permits it;
- submit unlawful, abusive, deceptive, or malicious URLs, content, instructions, or payment data; or
- use the Service in a way that creates a security, legal, operational, or reputational risk for us or another person.
We may apply reasonable rate limits and technical safeguards. We may suspend or refuse access where we reasonably believe these rules have been or may be breached, while taking account of any rights that cannot lawfully be limited.
8. Reports, availability, and sharing
We aim to make reports available promptly after payment confirmation, but processing time depends on the site, page count, network conditions, and provider availability. A report reflects the information observed at the time of scanning and can become outdated immediately if a site changes. Re-running an audit may produce different results.
Report URLs are intended to be unlisted, not secret. Anyone who obtains a report URL may be able to view it, and search engines or other services could discover it if it is shared publicly. You are responsible for deciding with whom to share a report or export. Do not put confidential information in a URL and do not rely on an unlisted link as an access-control mechanism.
We may impose reasonable limits on retention, bandwidth, or automated access where needed to protect the Service. We do not promise that a report will remain available indefinitely. Download or export anything you need to keep.
9. Intellectual property and report licence
The Service, software, design, branding, copy, scoring methods, check descriptions, report templates, and other materials supplied by nanoSEO are owned by us or our licensors and are protected by intellectual-property laws. These Terms do not transfer ownership of those materials to you.
Subject to payment and compliance with these Terms, we grant you a limited, non-exclusive, non-transferable licence to use the report produced for your order for your internal business and website-improvement purposes, and to share that report with your advisers or contractors who need it for those purposes. You may quote or link to factual findings in the report. You may not resell the Service, represent the report as a substitute for independent professional advice, remove attribution where attribution is legally required, or use nanoSEO branding in a misleading way.
You retain ownership of the URLs, content, and materials you submit. You grant us the limited rights needed to access, scan, process, store, and display those materials to provide the Service and comply with law.
10. Third-party services
The Service relies on third parties, including Cloudflare for hosting, storage, security, and delivery, and NanSwap for crypto payment processing and its embedded checkout. Their services, terms, availability, fees, and privacy practices are outside our direct control. You must comply with the terms that apply to the payment method you use.
Links to third-party sites are provided for convenience and do not mean we endorse or control them. We are not responsible for a third party’s website, wallet, exchange, blockchain, content, or acts or omissions, except to the extent applicable law says otherwise. If a third-party service fails, we may be unable to complete or verify an order until it recovers.
11. Disclaimers
To the maximum extent permitted by law, the Service and reports are provided “as is” and “as available”. We disclaim implied warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, and uninterrupted or error-free operation. We do not warrant that a scan is complete, that a recommendation is suitable for your circumstances, or that following a recommendation will improve rankings, traffic, sales, or any other result.
You are responsible for checking that a recommendation is lawful, accurate, technically safe, and appropriate for your site before implementing it. Nothing in this section limits a warranty or right that applicable consumer law does not allow us to exclude.
12. Limitation of liability
To the maximum extent permitted by law, nanoSEO will not be liable for indirect, incidental, special, consequential, exemplary, or punitive loss, or for loss of profits, revenue, anticipated savings, goodwill, data, rankings, traffic, business opportunity, or website availability, arising from or related to the Service or these Terms, even if we were advised that the loss was possible.
To the maximum extent permitted by law, our total aggregate liability arising from or related to the Service or these Terms will not exceed the amount you paid to nanoSEO for the order giving rise to the claim. This cap does not apply to liability that cannot lawfully be limited, including liability for fraud, wilful misconduct, death, or personal injury caused by negligence where such a limit is prohibited.
Nothing in these Terms excludes or restricts your mandatory rights as a consumer in the UK, EU/EEA, the United States, Canada, Australia, New Zealand, Brazil, or any other jurisdiction. If a provision is found unenforceable, the remaining provisions continue to apply and the unenforceable part will be limited only to the extent required by law.
13. Force majeure and events outside our immediate control
We are not responsible for a failure or delay in performing an obligation to the extent it is caused by a force majeure event or any other event outside our immediate control. These events include, without limitation: acts of God; natural disasters; severe weather; fire; flood; earthquake; landslide; epidemic, pandemic, or public-health emergency; war; invasion; hostilities; terrorism; civil unrest; riot; civil or military action; labour dispute, strike, or lockout; government action, law, regulation, order, sanctions, export control, or failure to grant a necessary licence or permission; cyberattack, malicious code, ransomware, denial-of-service attack, vulnerability, or other security incident not caused by our failure to use reasonable care; internet, telecommunications, DNS, cloud, hosting, content-delivery, software, or power failure; failure or delay of a third-party provider, including Cloudflare, NanSwap, a wallet, exchange, bank, payment network, or blockchain; blockchain congestion, fork, rollback, validator failure, or transaction delay; inability to obtain necessary services, data, or materials; and any other cause beyond our reasonable control.
Where such an event prevents or delays performance, our affected obligations are suspended for the duration of the event and for a reasonable recovery period. We will use reasonable efforts to reduce the effect and resume the Service. This does not excuse us from taking reasonable steps to protect information or from obligations that applicable law does not allow us to suspend.
If a force majeure event continues for more than 30 days and materially prevents delivery of an affected paid order, either party may cancel that affected order by written notice. We will handle any prepaid amount for the undelivered part in accordance with applicable law, including any non-waivable consumer rights.
14. Suspension and termination
We may suspend, restrict, or terminate access to the Service if we reasonably believe you have breached these Terms, created a security or legal risk, attempted to abuse the Service, or failed to pay an amount due. Where practical, we will give notice and a reasonable opportunity to remedy the issue. We may also suspend the Service for maintenance, security, legal, or operational reasons.
Ending access does not cancel rights or obligations that by their nature survive, including payment obligations, intellectual-property provisions, disclaimers, liability limits, and dispute provisions. It also does not remove any right you have to a remedy under applicable law.
15. Worldwide consumer and legal rights
These Terms apply worldwide, but local law may give you rights that cannot be waived. Nothing here excludes mandatory protections available in your country, state, province, or territory. In particular, consumers in the United Kingdom and European Economic Area keep their statutory rights; Canadian consumers keep applicable provincial and federal rights; Australian consumers keep rights under the Australian Consumer Law; New Zealand consumers keep rights under the Consumer Guarantees Act and Fair Trading Act where applicable; and Brazilian consumers keep rights under the Consumer Defence Code and LGPD where applicable.
If you live in the United States, nothing in these Terms limits a non-waivable right under applicable federal, state, or local law. This includes applicable consumer-protection, privacy, warranty, and unfair-or-deceptive-practices protections. We do not require you to waive a right to bring a claim, participate in a class or collective action, or use a local forum where the law does not permit that waiver. State-specific privacy rights are described in our Privacy Policy.
If any part of these Terms is invalid or unenforceable in your jurisdiction, it will be interpreted to give the greatest lawful effect to its purpose, and the rest of the Terms will remain in force.
16. Governing law and disputes
These Terms are governed by the laws of England and Wales, without regard to conflict-of-laws rules. Subject to any mandatory consumer forum rights and any right to bring a claim in a court that cannot lawfully be excluded, the courts of England and Wales will have non-exclusive jurisdiction over disputes arising from these Terms or the Service.
Before starting formal proceedings, please contact us at cw228911@gmail.com with the order ID, a description of the issue, and the remedy you seek. We will try to resolve the matter promptly. This paragraph does not require you to delay a claim where a limitation period or mandatory law makes that inappropriate.
The United Nations Convention on Contracts for the International Sale of Goods does not apply to these Terms to the extent its exclusion is permitted.
17. Changes to these Terms
We may update these Terms to reflect changes in the Service, law, security, or our practices. We will publish the revised version here and update the “last updated” date. Changes apply prospectively to use and purchases after publication. An order is governed by the version accepted when that order was placed, unless a later change is required by law. Where required, we will provide additional notice. If you do not agree to a change, you should stop using the Service; this does not affect rights already accrued.
18. Contact
